Travelistic Upload, Share and Win Contest Rules

To provide fair and equal chance of winning to all entrants of Travelistic.com contests, the following are the official rules for all Upload, Share and Win contests (the “Contests”) on Travelisitic.com.

NO PURCHASE NECESSARY. PURCHASE WILL NOT IMPROVE CHANCES OF WINNING.

All entrants must be 18 years of age or older, unless otherwise stated and/or posted.

The Contests begins on the first of the month and ends the last business day of the month, unless otherwise stated on the particular Contest detail page on Travelistic.com (the “Contest Detail Page”).

The Contests are open to all legal residents of the United States and the District of Columbia. Void where prohibited.

1. Entering Contests and Choosing and Contacting Winners

Winners of our Upload, Share and Win contests will be chosen based on the valid entry that is viewed the most often by users of Travelistic.com.

To be a valid entry, an entry must:

Be between 1 minute and 6 minutes in length;
Be properly tagged as described on the particular Contest Detail Page;
Contain content appropriate to the particular Contest as described on the Contest Detail Page;
Be entered along with a valid email address and any other required information requested on the Contest Detail Page; and
Not contain any illegal or obscene material.

Travelistic is not responsible for and will not consider incomplete, invalid or incorrect entries, as potential contest winners.

Winners of all contests will be contacted at the registered email address used to enter the contest, and the person receiving and replying to the winner announcement email will be considered the winner unless they specify another person within the reply email as the winner. Travelistic will mail the contest prize to the address supplied by the recipient of the winner announcement email.

Travelistic.com encourages multiple entries in the Contest. You may enter any Contest more than once using the same email address.

Claiming of prizes requires an email response to Travelistic from the winning sender email address within 30 days of being notified of winning at the email address used to enter. Failure to respond shall mean that the winner forfeits the prize. Any prizes forfeited by the chosen winner will be awarded to the runner-up.

By submitting any video or information to Travelistic, you hereby grant to Travelistic and its affiliates, parents, subsidiaries, licensees and assigns, an irrevocable, perpetual and royalty-free right to use, reproduce, edit, display, perform, transmit, prepare derivative works of, modify, publish and otherwise make use of the submitted video or other information and to use all the names and likenesses included in the video in any and all media, whether now known or hereinafter created, throughout the world and for any purpose. In addition to other things, the rights granted to Travelistic includes but is not limited to the right to resize, crop, censor, compress, edit, feature, caption, affix logos to, and to otherwise alter or make use of the submitted video;

By submitting any video or information to Travelistic, you hereby represent and warrant that the video or information does not and shall not infringe on any copyright, any rights of privacy or publicity of any person, or any other right of any third party, and you have the right to grant any and all rights and licenses granted to Travelistic herein, including but not limited to all necessary rights under copyright, free and clear of any claims or encumbrances. You also hereby represent and warrant that you will not upload, post, email, transmit, or otherwise make available through Travelistic.com any material that contains software viruses, worms, Trojan horses, bombs, or any other computer code, files or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or any telecommunications equipment.

You acknowledge and agree that although Travelistic does not pre-screen content posted as part of any Contest, Travelistic shall have no obligation to post, display or otherwise make publicly available any video or information submitted by you, and may, in its sole and unfettered discretion, remove, edit, modify or delete any video or information that you submit to Travelistic;

You understand and intend that any video or information submitted by you to Travelistic may be available for viewing, rating, review and comment on by the public, and understand that Travelistic is not responsible for these comments or ratings, you will not interfere with, manipulate, or take any actions that may undermine the integrity of the comments or ratings in any way, and comments or ratings with which you disagree or are unhappy about may be published or otherwise become associated with any video or information you submit to Travelistic. By submitting any video or information to Travelisitic, you hereby waive any privacy expectations that you may have with respect to any such video or information submitted by you to Travelistic.

You hereby agree to hold Travelistic and its affiliates, parents, subsidiaries, directors, officers, members, licensees, sponsors and assigns harmless from and against, and hereby waive any right to pursue, any claims of any nature arising in connection with the inclusion in, publication via or display on any Travelistic site, or any other use authorized under these Terms, of any video or information submitted to Travelistic by you;

Video or information submitted by you to the Site shall be the property of Travelistic, and Travelistic shall have no obligation to preserve, return or otherwise make available to you or others any videos or information so submitted.

2. Awarding Prizes

Winners are solely responsible for all taxes and/or fees that may be incurred. All cash winners are required to verify proper and legal picture identification and Social Security number within 30 days of notification of winning the cash prize. Winner may forfeit any and all cash winnings if verification cannot or has not been made within 30 days. Upon proper verification, cash winnings will be awarded by check, and mailed to winner's mailing address within seven (7) business days.

Each prizewinner must supply Travelistic with his/her legal name, mailing address, birth date, daytime and nighttime telephone numbers. In the case of a cash winner, winner must also supply social security number.

Winners may not request substitutions of prize winnings. All winners are solely responsible for any and all taxes and/or fees, and all such additional costs that may be incurred.

Neither Travelistic, Travelistic sponsors, nor employees of Travelistic or sponsors may be held liable for any warranty, costs, damage, injury, or any other claims incurred as a result of usage of any winners of a prize once possession has been taken of the product by winner. Travelistic is not liable for any loss arising out of or in connection with or resulting from any contest promoted by Travelistic.

If the specified prize becomes unavailable due to unforeseen circumstances, Travelistic may substitute a prize of like or equal value.

3. General

Management, employees and families of Travelistic are prohibited from winning any prizes awarded by Travelistic. Travelistic reserves the right to alter any rules of any Contest at anytime. Except where prohibited, participants agree that (1) any and all disputes, claims or causes of action arising out or connected with the Contests or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by arbitration or alternate dispute resolution, as selected by Travelistic, to take place in the County of New York, State of New York; (2) any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred in participation but in no event attorney’s fees; and (3) under no circumstances will a participant be entitled to obtain awards for and participants hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket costs, and any and all rights to have damages multiplied or otherwise increased.

Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these rules and the decisions of Travelistic in connection with the Contests, shall be governed by and construed in accordance with the laws of the State of New York, without regard for conflict of laws doctrine.

Should any term or provision of these rules be concluded to be void, unenforceable or contrary to applicable law as provided herein, such term or provision shall, but only to the extent necessary to bring the rule within the requirements of such law, be deemed to be severed from the other terms and conditions; and the remainder of these rules shall be given effect as if it had not included the severed item.

For the name of the prize winners, mail a self-addressed stamped envelope to: Diversion Media “Upload, Share and Win” [Contest Name] Winners List, 900 Broadway, Suite 900, New York, NY 10003 for receipt within one year of the conclusion of the Contest. The name of the winners also may be posted on Travelistic.com.

The Contests are being operated by Diversion Media, LLC (referred to herein as “Travelistic”).
